Dispute Resolution & Arbitration Provision:

The arbitration shall be held either in California or within the jurisdiction of the nearest U.S. District Court to your billing address, as chosen by the party requesting arbitration. Unless required by law, both you and WORLD OF WINE, LTD shall share equally in the arbitration expenses, with each party bearing its own legal fees and costs.
This Arbitration Provision is designed to encompass disputes that would otherwise fall under the jurisdiction of a court or another non-arbitration forum. By agreeing to this Arbitration Provision, you waive your right to have such disputes resolved by a jury or through alternative forums. Should you wish to avoid the binding nature of this Arbitration Provision, you have the option to opt out by notifying WORLD OF WINE, LTD in writing of your decision within thirty (30) days from the date of your acceptance of WORLD OF WINE, LTD's Terms of Service, including this Arbitration Provision.
The stipulations of this Arbitration Provision are governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq. (the "FAA"), and exemplify a transaction involving interstate commerce. Should any portion of this Arbitration Provision or the regulations of the Judicial Arbitration Mediation Service or American Arbitration Association be deemed unlawful, invalid, or unenforceable by the Arbitrator or a court with proper jurisdiction, such segments shall be excised or adjusted to the extent necessary for the continued enforceability of this Arbitration Provision to the maximum extent allowable under applicable law.

Due to the ever-changing nature of wine shipping laws, we may be able to ship wines, directly or indirectly, to all states except AL, AR, DE, IN, MI, MS, OH, OK, RI, SD & UT. If WORLD OF WINE, LTD is unable to ship directly to your state, we can arrange for the shipment of products through a third party. Please note, when dealing through a third party, wine prices, discounts, and shipping costs may differ from those quoted by WORLD OF WINE, LTD.

UPS Ground is WORLD OF WINE, LTD's carrier of choice. Ground shipping is provided by UPS Ground at current market rates.
Wine is a perishable commodity. Wine does not like extremes of temperature: hot humid summer and cold winter weather may adversely affect the condition of your wine during shipment. WORLD OF WINE, LTD is not responsible for, and will not replace wine that is damaged by extreme weather conditions during shipment. When your wine order is picked up by the common carrier for delivery, responsibility for the wine becomes the responsibility of the purchaser.
